Overview of unpaid internships

In most cases you will need an employment permit in order to gain experience in your field of study. It is understandable that you might think that accepting a job for which you are not paid is not considered employment and therefore does not require a permit. However, this is not true.

Entry requirements view employment as any type of work or service provided for money, tuition, fees, books, supplies, housing, or other benefit.

Volunteering enables you to get involved in the local community, network, use skills and learn new things.

The U.S. Department of Labor defines volunteering as giving time to an organization whose primary purpose is civil, charitable, or humanitarian. Keep in mind that you may not receive any payment or any type of compensation.

Do I need a work permit to do an unpaid internship?

A work permit is not required for an unpaid internship that meets all of the criteria. Inquire in advance what documents the organization will need from you in order to begin your unpaid internship. If they want you to fill out Form I-9 to confirm the employment permit, it means that the employment relationship is subject to approval, even if you are not paid. When you complete your program, you will need an F-1 OPT or J-1 Academic Training permit for both paid and unpaid positions.

Can ISSO issue me with a permit for an unpaid internship?

The ISSO can authorize Praktikum Curriculars (CPT) for both paid and unpaid positions. If the unpaid internship is not CPT-capable, we cannot check unpaid internships for labor law regulations and are not authorized to issue a permit.

Do I need a work permit for voluntary work?

You are not required to obtain a work permit to engage in legitimate volunteering.

How can I prove that my position is an unpaid internship or volunteer work?

We recommend that you obtain records from the organization explaining the nature and conditions of your work and keep them with your other immigration records.
